What to do if you Slip and Fall in Las Vegas
- posted: Oct. 06, 2021
When you visit Las Vegas, you are not expecting to find yourself injured and in need of medical and legal attention. But sometimes that happens, and many times it is not your fault. Nevada requires businesses to maintain their premises to ensure they can be safely used. If you or someone you care about slipped or tripped and fell in Las Vegas, the steps to take immediately after the fall are critical to preserving evidence ensure the best possible legal case. It is important to know what to do BEFORE the worst happens.
Steps to take to Protect your Rights
First, report the incident and document everything. If you’re able to move without further injuring yourself, take pictures of the area where you fell, including what you slipped or tripped on. If it is a liquid substance on a shiny floor, you might have to take a picture at an angle to be able to see the liquid. Take pictures of your clothing and your shoes. Find an employee to report the fall. Document the name of all employees you talk about the incident. If you had to leave the area to find someone to report to, make sure you take an employee back to where you fell so there is no confusion about where it happened. If they ask for a written statement, be as specific as possible and take a picture of your statement before you give it back to them and request a copy of the full incident report. They likely will not give it to you, but ask for it anyway.
Second, get medical treatment if you need it. Sometimes immediately following an incident, you will be embarrassed and try to ignore the pain you are experiencing. Sometimes a little ice, rest, and relaxation will be enough. Be honest with yourself about whether you need treatment. If you hit your head, strongly consider going to the hospital to make sure there is not a brain injury. After some rest, you may notice you are still experiencing pain. Don’t try to be strong and fight through the pain. Slip or trip and falls can lead to serious injury. Consult with a doctor about any pain you are experiencing.
Finally, do not sign anything that can affect your right to make a claim against the responsible parties without first speaking to an attorney. An experienced attorney can help you navigate and avoid the pitfalls of filing a lawsuit after a slip or trip and fall. These cases are complex and difficult to prove. Don’t be the victim twice.
